Recently, INS released their long-awaited regulations concerning the 'V' visa. This visa allows relatives of lawful permanent residents and U.S. citizens, who have pending petitions for green card status, to get a visa and work permission while waiting for the visa status to become "current", that is, eligible to file for a green card. To be eligible, you must have a visa petition which was filed on your behalf by an immediate relative and has been pending for more than three years. If this petition is already current, then the 'V' visa is not for you as you can apply for your green card immediately. The 'V' visa applies both to those within the U.S., regardless of current INS status, as well as those waiting overseas.
